1. The agreement
"SunSolarOne", "we" and "us" mean Atharva Green Energy Solution Pvt Ltd, registered office The Corporate Park, Office No. 902, 9th Floor, Plot No. 14/15, Sector 18, near Warna Dairy, Vashi, Navi Mumbai, Maharashtra 400705. "You" means the company or business that creates the workspace, and "users" means the people you allow to use it. The agreement is made up of these terms, our Privacy Policy, our Data Processing terms, our Refunds & Cancellation policy and the plan you choose. SunSolarOne is provided for business use only; it is not a consumer service.
2. Accounts and teams
- You must give accurate company and contact details and keep them up to date.
- The account owner controls the workspace, decides who is invited and what role each user has, and is responsible for everything done by its users.
- Keep passwords and OTPs confidential. Tell us at once at support@sunsolarone.com if you suspect unauthorised access.
- Users must be at least 18 years old.
- Any user can delete their own sign-in from the app or the website (see Delete your account). The account owner must hand over ownership first if other users remain.
3. Free trial
New workspaces may start with a free trial (currently 14 days). We do not charge you during the trial. At the end of the trial you can choose a paid plan; if you do not, the workspace becomes read-only and is handled as described in section 12. We may change or end trial offers for new sign-ups at any time.
4. Fees, GST and payment
- Fees are as shown on our pricing page or in your order at the time you subscribe, and are exclusive of GST, which we add at the applicable rate. Enter your GSTIN to receive a GST invoice you can claim input tax credit on.
- Subscriptions are billed in advance, monthly or annually, and renew automatically for the same period unless you cancel before the renewal date. Recurring payments run on a mandate you authorise with Razorpay (card, UPI AutoPay or e-NACH), with the pre-debit notifications the Reserve Bank of India requires; you can cancel the mandate at any time.
- Payments are collected through Razorpay. If a payment fails, we will remind you and may restrict the workspace to read-only after 7 days, and suspend it after 30 days, until it is paid.
- We may change prices with at least 30 days' notice. Changes apply from your next renewal; if you do not agree, you can cancel before then.
- Refunds are covered by our Refunds & Cancellation policy.
5. Acceptable use
You agree not to, and not to let anyone else:
- use SunSolarOne for anything unlawful, fraudulent or misleading, including false subsidy or DISCOM claims;
- send spam or unsolicited commercial messages, or message people who have not agreed to hear from you, in breach of TRAI regulations, DLT rules or WhatsApp's Business and Commerce policies;
- upload data you have no right to use, or malware;
- try to access another company's data, probe or break our security, or overload the service;
- copy, resell or reverse-engineer the service, or use it to build a competing product;
- scrape the service or use automated tools beyond the features and APIs we provide.
We may suspend accounts that break these rules, with notice where it is reasonable to give it.
6. Your data
You own the data you and your users put into SunSolarOne ("your data"). You give us permission to host, copy, process and display it only as needed to provide, secure and support the service, and as described in our Privacy Policy. You can export your data at any time from Settings → Export. We do not sell your data or use it to train AI models.
We may use aggregated, anonymised statistics that do not identify you, your users or your customers to operate and improve the service.
7. Your customers' data
For the personal data of your leads and customers, you are the Data Fiduciary under the Digital Personal Data Protection Act, 2023 and we are your Data Processor. You are responsible for having a lawful basis to collect that data, giving your customers the notices the law requires, getting their consent where needed (including before sending them WhatsApp or SMS messages), and responding to their requests. Our Data Processing terms form part of this agreement.
8. Estimates and calculations
System sizes, shade analysis, generation, savings, payback, subsidy amounts, EMI figures, bill readings and bills of quantities are estimates produced from the data entered, public datasets and standard models. They are tools to help your team; they are not engineering certification, financial advice or a guarantee of performance or subsidy approval. You are responsible for checking them, for the designs, quotes and commitments you give your customers, and for complying with DISCOM, MNRE and PM Surya Ghar rules. Lender details shown in proposals are indicative samples; SunSolarOne does not lend money or arrange loans.
Customer acceptance. When your customer accepts a proposal online, SunSolarOne records their typed name, a one-time password sent to their phone or email, the time, a hashed network address and a hash of the proposal PDF. This is an electronic record of acceptance that can form a contract under section 10A of the Information Technology Act, 2000; it is not an electronic signature under section 3A and the Second Schedule of that Act (such as Aadhaar e-Sign or a digital signature certificate). For documents that the law, a DISCOM, MNRE, a lender or a government scheme requires to be signed with a recognised electronic signature or in ink (for example net-metering agreements, subsidy applications or loan papers), you are responsible for getting that signature separately.
9. Third-party services
Some features rely on services we do not control, such as maps and satellite imagery, WhatsApp, SMS gateways, payment gateways, lead sources like IndiaMART or JustDial, and inverter-monitoring clouds. Their own terms apply to your use of them, and we are not responsible for their availability or content. If you connect your own account with such a service (for example, your Razorpay account to collect customer payments), you are responsible for that account and its terms.
10. Availability and support
We work to keep SunSolarOne available and fast, and to schedule maintenance outside Indian business hours where we can. We do not promise uninterrupted service. Support is available by email at support@sunsolarone.com on Indian working days. We may improve, change or remove features; if we remove a feature that is material to your paid plan, we will tell you in advance.
11. Intellectual property
SunSolarOne, its software, design and content belong to us or our licensors. We give you a non-exclusive, non-transferable right to use the service during your subscription, for your internal business purposes. If you send us feedback, we may use it without any obligation to you. Your logo and branding remain yours; you let us show them in your proposals and documents.
12. Cancellation and termination
- You can cancel at any time from Settings or by writing to us. Cancellation takes effect at the end of the current billing period.
- We may end the agreement with 30 days' notice, or immediately if you seriously breach these terms (including non-payment) and do not fix the breach within 15 days of our notice.
- After the agreement ends, your workspace becomes read-only for 30 days so you can export your data. We then delete it from our live systems, and from backups within a further 30 days, except records we must keep by law (such as our invoices to you).
13. Disclaimers
Apart from what these terms expressly say, the service is provided "as is" and "as available". To the extent the law allows, we disclaim all other warranties, including fitness for a particular purpose and that the service will be error-free.
14. Limitation of liability
To the extent the law allows, neither party is liable for indirect or consequential loss, or loss of profit, revenue, business or goodwill. Our total liability arising out of or relating to the agreement in any 12-month period is limited to the fees you paid us for the service in those 12 months. These limits do not apply to liability that cannot be limited by law, or to your payment obligations or your breach of section 5.
15. Indemnity
You will defend and compensate us against claims by third parties (including your customers or a regulator) arising from your data, your messages to your customers, the quotes and designs you provide, or your breach of these terms or the law.
16. Governing law and disputes
These terms are governed by the laws of India. We will first try to settle any dispute through good-faith discussion for 30 days. If that fails, the dispute will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated in Navi Mumbai, conducted in English. Subject to that, the courts at Navi Mumbai have exclusive jurisdiction.
17. General
- We may update these terms. For material changes we will give account owners at least 15 days' notice by email or in the app; continuing to use the service after that means you accept them.
- Neither party is responsible for delays caused by events beyond its reasonable control.
- You may not transfer the agreement without our consent; we may transfer it to a successor of our business.
- If any part of these terms is unenforceable, the rest stays in force. Not enforcing a right is not a waiver of it.
- Notices to us go to support@sunsolarone.com; notices to you go to the account owner's email.
